21日提請全國人大常委會審議的關于刑法有關規定的解釋草案明確指出，知道或者應當知道是國家重點保護的珍貴、瀕危野生動物及其制品，為使用或者其他非法用途而購買的，將被追究刑責。也就是說，從市場買珍貴、瀕危野生動物來吃或到餐館專門點吃的，將受到刑法處罰。
